TGC lawyer Ania Konikowski successfully resisted an employer’s attempt to defer a Human Rights complaint brought by an employee who was fired while he was in hospital.
The employer argued that the Human Rights complaint should be deferred because it overlapped with a wrongful dismissal lawsuit brought by the same employee. The Human Rights tribunal rejected this assertion in favour of Ania’s argument that the complaint and the lawsuit dealt with different issues.
This is an important outcome for the employee as it upholds his entitlement to pursue all of the legal remedies arising from his termination.
