The former employee was seeking damages for a so-called “wrongful dismissal”.
The Trial Judge dismissed the claim against our client, and furthermore ordered the former employee to pay to our client a 5% ($1250) penalty for pursuing a case with no reasonable prospect of success. In addition, the former employee was also ordered to pay disbursements to our client.
