TGC lawyer Fred Wynne was quoted in a December 25, 2021, article in the Vancouver Sun entitled “When home is where the workplace is, injury claims get murky”.
In the article, Fred talks about the legal “grey zone” that exists when workplace injuries occur while an employee is working remotely:
“If you go straight from your desk to the kitchen and have an accident on the way … then that is more analogous to walking into the lunchroom,” said Fred Wynne, a lawyer at Tevlin Gleadle Curtis Employment Law Strategies.
“But if you stop on the way, and you’re doing another task, that’s more analogous to walking down the street to the cafe,” a task that wouldn’t be covered by WorkSafeBC.
Wynne believes these types of claims will increase as people continue their professional lives from home, claims that will receive significant scrutiny from WorkSafeBC.
