TGC lawyer Ian Kennedy, acting for an employer, successfully overturned a decision by the Director of Employment Standards that would have treated two employees as labourers rather than farm workers for the purposes of overtime and statutory holiday pay.

This decision is significant for the employer and for other employers in the same area and does not appear to have been directly addressed by the B.C. Employment Standards Tribunal  prior to this case.
