TGC lawyer David McWhinnie successfully defended a Vancouver doctor from a lawsuit that included claims for wrongful resignation and breach of fiduciary duty.
The case arose from a breakdown in relations among a group of physicians who had been practicing together at a Vancouver reproductive medicine clinic. That breakdown eventually lead to the departure of some of the physicians and the establishment of a new, competing clinic.
The central issue in the case was the extent to which the departing physicians were entitled to practice in competition with the original clinic.
Part of the case involved David making submissions about the nature of medical corporations and the legal and ethical responsibilities of physicians.
