TGC lawyers Martin Sheard and Steven Barker won aggravated damages for an employee who was challenging her termination by her former employer Canada Shineray Suppliers Group Inc.
The employer was alleging, amongst other things, that it had just cause for termination.
In her decision, Madam Justice Fisher found that the employer had not established just cause and also that the conduct of the employer: “was untruthful, misleading and unduly insensitive, constituting conduct made unfairly and in bad faith”. In the result, the judge awarded aggravated damages to the employee to compensate for mental distress arising from this “devastating” conduct.
