Wrongful dismissal is a legal phrase that describes a situation where an employee has been terminated in a manner that breaches one or more terms of his or her employment contract.

Usually, wrongful dismissal describes the situation where an employee is terminated without cause and without reasonable, or any, notice.

Wrongful dismissal can also include the situation where an employer has wrongly alleged cause for termination.

Sometimes employees will have written employment contracts that address matters like termination and notice. Where an employee does not have a written employment contract, or where that contract is deficient or unenforceable, the relevant terms may be implied by law.
